Fusion Source Technologies
provides server space and performs programming (including the design and building of Web sites.) Many of the services we provide depend in turn on other providers over whom we have no direct control. Please read the following conditions which apply to all our services, products, and custom programming. If you do not accept these conditions, please contact us as soon as possible.
- The public nature of the Internet make it impossible for us to guarantee absolute privacy and security for your data, communications, or any material placed on a server connected to the Internet.
- While we perform regular back-ups on the servers, it is impossible for us to insure against partial or complete loss of data, programs, Web pages, or any other material placed on our servers. We suggest that you keep back-ups of all material placed on the Internet.
- We buy services from a number of suppliers. You agree to the limitations and conditions imposed by their separate service agreements.
- If you contract with us for server space, you grant us the right to move your materials from one server to another. If this becomes necessary, we will make every effort to insure that your URL address remains the same (in general we provide a URL that can be easily remapped to a different IP address, with the change being invisible to the end user.)
- While every effort is made to insure availability, we cannot guarantee that access to your Internet server space and applications will not be interrupted for short periods, or in extreme cases even for days. In the unlikely event that a long interruption in service occurs, we will provide a pro-rata refund for the period during which service was unavailable.
- We make no guarantees with respect to the number of Internet users who will see or respond to any materials you place on the Internet, or the volume of business you will attract.
- All programming and other services we provide are provided on an `as is' basis. It is your responsibility to check the suitability of the provided programming or services for their intended use.
- You agree that in no case will
Fusion Source Technologies or any of it's employees, subcontractors, or suppliers be held liable for any direct, incidental, or consequential damages resulting from the use of our products or services, or out of breach of any warranty. This includes, but is not limited to, loss of anticipated profits, benefits, use, data, or programs.
- By utilizing our products or services, you accept the above terms. If you do not accept these terms, please contact us to arrange for the termination of any services we are currently providing.
