Summary of
Acceptable Use Policy |
The
following restrictions apply to
our accounts. Please note that
this list is not exclusive, please
check with us if you have any
doubts about something you are
planning to do.
- Spamming
in any form, even through
other providers or on
newsgroups if it in any way
concerns our servers (e.g.
mentions a domain name we
host).
- Anything
that effects the performance
of the servers adversely
(looping jobs, long running
programs that leak or eat
resources, security holes).
- Using
resources on our machines to
proactively annoy or threaten
people - see note below on
free speech.
- We
grant a wide latitude for free
speech, but any promotion of a
site that is "in your
face" will get our
attention (the primary example
of this is spamming, but I'm
sure there are other ways). We
do not monitor site contents,
but our acceptable use policy
requires sexually explicit and
other kinds of sites that are
not suitable for minors to be
behind some form of adult
check (NOT just a warning
message).
- Only
Unix Developer Accounts
are allowed to contain adult
material under the Fusion
Source Hosting policy.
- There
are some limits to what kind
of speech we will allow as
well, but so far we have not
had any problems here,
although we have had some
groups that came pretty close
to the line between political
and hate speech (the latter
would get you kicked off).
- Content
of all sites must be legal (no
pirate software, etc.).
- We
reserve the right to close
down or lock out a site for
reasons not listed above. You
will not be entitled to a
refund of any server fees from
the time the account is taken
off-line.
Email
Spamming
- "US
Code Title 47,
Sec.227(a)(2)(B), a
computer/modem/printer meets
the definition of a telephone
fax machine. By
Sec.227(b)(1)(C), it is
unlawful to send any
unsolicited advertisement to
such equipment. By
Sec.227(b)(3)(C), a violation
of the aforementioned Section
is punishable by action to
recover actual monetary loss,
or $500, whichever is greater,
for each violation."
- Fusion
Source Hosting does not allow
email spamming from accounts
on our machines.
"Spamming" is
defined as sending unsolicited
email to a list of email
addresses. For example buying
a list and sending email to
this list is spamming. We
judge whether an email spam
has occurred by the nature and
volume of complaints we
receive from people who
receive the email.
- Spamming
is an issue regardless of
where the email is sent from,
if the spam in any way
involves our services (e.g.
webhosting). This is known as
a zero-tolerance policy on
junk mail. We do not have the
need or desire to waste our
time, hardware, and money on
people whom spam or send
unsolicited commercial email.
The volume of bounces and
complaints generated far
outweighs the value of a
single account, which in the
end will damage our
reputation. Junk mail is at
best a nuisance and at worst
can crash systems or entire
networks when the fed up
attacks back. Some of the
consequences of spam:
- You
will be billed for the
time spent as a result of
your spam (this can
include answering emails,
fending of "denial of
service attacks",
etc)
- You
will be charged for any
consequential damages.
These costs can
potentially be very large
(e.g. loss of use of our
machines for any period of
time, loss of accounts,
etc)
- Depending
on the nature of the spam
and previous occurrences,
we will take the following
actions:
- Account shutdown for a
period of time
- Account termination
Content
Restrictions
- Only
Unix Developer Accounts
are allowed to contain adult
material under the Fusion
Source Hosting policy.
- We
do not monitor or restrict
content on our sites. You are
responsible for your content
and making sure both the
content and access to it are
in conformance with all
applicable laws.
- In
addition, if your site
includes graphic images, or
any images to which children
should not be exposed, we
require that all such explicit
material be restricted to
consenting adults through the
implementation of protected
passwords. There are a number
of technologies for
restricting a site to adults
that cost very little to
implement (for both you and
the customer). If you need
help with this please let us
know.
High
Bandwidth Accounts
- When
we notice that an account is
likely to transfer more than
the maximum amount of data
included with the account, we
ask for a deposit to cover one
month's anticipated use. This
policy has been dictated by
some early bad experiences,
and by the fact Fusion Source
Hosting incurs real out of
pocket expenses in excess of
the rates charged for marginal
bandwidth. We hope you will
understand that this policy is
applied generally.
